TERMS AND CONDITIONS

Product Availability & Orders

• All plants and products are sold on a first-come, first-serve basis.
• Orders are only confirmed once full payment has been received.
• We do our best to keep stock updated, but availability may change without notice.
• Plant sizes, shapes, and colors may vary slightly from photos due to natural growth.

Payments

• Payments can be made via direct bank transfer or in cash upon collection. We also accept cash at the flea market.
• Proof of payment must be sent, and funds must reflect in our account before any orders
  are dispatched.
• All sales are final.
• Orders must be paid in full within 48 hours of placement. Unpaid orders will be canceled.

Courier & Collection

• Orders can be collected from Lusthof Kwekery by prior arrangement.
• We offer courier services via The Courier Guy or PUDO at the buyer’s expense.
• Shipping costs will be provided upon request and must be paid before dispatch.
• We take great care in packaging, but we are not responsible for damage caused during
  transit.
• Courier shipping times are estimates and may vary due to external factors beyond our
  control.

Plant Health & Care

• We ensure that all plants sold are healthy and in good condition.
• Once collected or shipped, plant care is the buyer’s responsibility. We are not responsible
  for plant health after pickup or delivery.
• Some plants may require specific care – please ask if you need guidance.

Returns & Replacements

• Due to the nature of live plants, we do not accept general returns.
• Refunds or exchanges are only permitted if:
  (a) The wrong plant is sent. Please notify us within 24 hours of receiving your order.
  (b) Clear photos of any issue must be provided before a refund or exchange is considered.
  (c) Return shipping costs will be at the buyer’s expense.
• We do not accept responsibility for damage caused by poor handling, incorrect care, or
  unsuitable environmental conditions after purchase.

Special Orders & Reservations

• Special orders for rare plants may require a deposit.
• Deposits are non-refundable if the buyer cancels the order.
• Reserved plants must be collected within 14 days, or the reservation will be canceled.

Liability & Risks

• Risk transfers to the buyer once the plant leaves the nursery (via collection or courier).
• Once a plant leaves Lusthof Kwekery, we are not responsible for any delays, damages, or
  loss during transit.
• We package plants securely, but transit conditions are beyond our control.

Privacy & Data Protection

• Customer information will only be shared with third parties for courier services.
• Personal data will not be sold or used for marketing purposes without explicit consent.
• We respect your privacy and ensure that your information is handled securely.

Changes to Terms & Conditions

• Lusthof Kwekery reserves the right to update these Terms & Conditions at any time.
• Any changes will be communicated to customers where necessary.
• Stock availability can change at any time without prior notice.
